What this guide covers
- Coverage usually depends on the age of the building and the type of property.
- The City of LA’s RSO covers most rental units in buildings first occupied on or before October 1, 1978.
- Current rent is what gets underwritten; future growth is assumed conservatively.
- Confirm coverage for the exact address and keep the documentation with the file.
Two layers of rules
California regulates residential tenancies at the state level, and many cities regulate them further. The statewide framework limits annual rent increases on qualifying properties and requires a stated reason for ending a tenancy after a period of occupancy. Local ordinances can cap increases more tightly and impose registration or relocation obligations.
For a Los Angeles or Inland Empire investor, the practical question is not whether rent rules exist. It is whether the specific building at the specific address is covered, and by which rule. A duplex in one city and a duplex in the next can sit under different regimes, and the difference shows up in the income a lender is willing to count.
The City of Los Angeles RSO
The Los Angeles Housing Department says the Rent Stabilization Ordinance generally applies to rental units in buildings first issued a certificate of occupancy on or before October 1, 1978, plus some replacement units. RSO units carry regulated annual increases, eviction rules and a registration requirement with the city.
For a lender this changes the rent conclusion. Appraisers usually work from in-place rents, so an RSO building with long-term tenants paying below market can support a smaller loan than a pro forma suggests. Bring the RSO registration and the rent history, and underwrite the property as it is.
An RSO building is not ineligible — it is underwritten on current rent with conservative growth assumptions.
Which properties are usually covered
The statewide rules generally apply to residential properties older than a set age, with newer construction exempt for a period after it is built. They generally do not apply to single-family homes and condominiums owned by an individual or a limited liability company rather than a corporation or investment trust, provided the required notice language is included in the lease.
The Inland Empire has fewer local ordinances than the LA basin, so coverage in Riverside and San Bernardino counties turns more on building age and the statewide framework. But the details decide the file, so the useful habit is to check the city’s ordinance and the building’s permit history for the exact address.
How a lender reads a regulated building
A regulated building is not a lending problem. Plenty of rent-controlled apartment buildings are financed every year. The lender’s response is to be careful about projections: it will underwrite current rent, and it may be unwilling to assume the increases a presentation shows for future years.
The more common issue is a below-market lease. A long-term tenant paying well under market produces a rent conclusion the appraiser cannot ignore, and the ratio is calculated on the actual income rather than the potential. In a regulated building, the gap between the two can be permanent rather than temporary, because the ordinance limits how quickly it can be closed.
Tenant situations that change the file
Lenders want to know that the rent in the appraisal is the rent that will be collected. A property with a tenant in place under a written lease is the cleanest version. A property with a month-to-month tenant is workable but needs documentation. A property with an occupant who is not paying, or with an eviction history, is a different conversation entirely.
Just-cause rules matter here. Ending a tenancy for a reason the ordinance does not recognize can be difficult and expensive, and relocation obligations may apply. An investor buying a property with a long-tenured tenant below market should underwrite the property as it is, not as it would be after a vacancy that may not be available.
- Current leases, including any addenda and notice language
- Rent roll with payment history for each unit
- The city ordinance that applies, and its coverage test
- Building permit history or year built, to test the age threshold
- Any registration or relocation obligations the city imposes
Where this shows up in the ratio
Rent regulation does not appear as a line item in PITIA. It appears in the rent conclusion, in the lender’s assumptions, and in the risk that the income you project is not the income you can realize. A file with a below-market tenant in a covered LA building will usually qualify for less debt than a similar file next door with a market lease.
The practical response is to run the numbers at the rent that exists. If the deal works at the current rent, the regulatory question is a matter of patience and planning. If it only works at the rent you hope to charge after a vacancy, the deal is a bet on an outcome the ordinance may not permit.
Questions
Short answers
How do I know whether my LA building is rent-stabilized?
Check the certificate of occupancy and the city’s records. The RSO generally covers rental units in buildings first issued a certificate of occupancy on or before October 1, 1978, plus some replacement units. Bring the RSO registration if the property has one.
Do rent caps make a property ineligible for a DSCR loan?
No. Coverage affects the assumptions a lender makes, not eligibility. Files are underwritten on current rent, and regulated buildings are financed routinely.
